Neuberger to discuss proposed marijuana laws on Legal Briefs

Toronto criminal lawyer Joseph Neuberger will examine the proposed marijuana legislation and changes to impaired driving laws tonight on the live call-in radio show, Legal Briefs, on AM640.

Neuberger, a partner with Neuberger & Partners LLP, and Lorne Honickman, legal analyst for AM640 and a partner with Brauti Thorning Zibarras LLP, will weigh in on the changes from 7 - 9 p.m. on Tuesday, April 18.

“We are discussing the proposed changes to the Criminal Code — the laws around drug impairment, including providing oral samples to police," Neuberger tells AdvocateDaily.com. "We'll also look at the proposed removal of the need for an officer to have reasonable suspicion to demand a roadside test, and the removal of what is commonly called the ‘last drink defence.'"

He says the proposed changes raise a number of legal questions.

“Will these changes pass constitutional scrutiny? Will the number of criminal charges increase and jam our courts with more litigation? Is this necessary to protect the public?”

Legal Briefs launched its first show in February and airs every Tuesday from 7 - 9 p.m. It was created to give the public an opportunity to call in and ask questions about the legal issues of the day, make comments and engage in dialogue with legal experts.
