Cohen to co-chair fertility law conference in Toronto

Toronto fertility lawyer Sara Cohen will co-chair a conference on Current and Emerging Issues in Fertility Law on Feb. 5.

The full-day event will be held at the Osgoode Professional Development Centre, on the 26th floor of 1 Dundas St. W., in Toronto. It will cover many topics, including criminal prohibitions, jurisdictional challenges, parentage claims, questions of consent, non-traditional parenting arrangements, and special issues relating to the LGBT community.

To kick off the conference, Cohen, founder of Fertility Law Canada at D2Law LLP, will offer an overview of fertility law. She will also participate in a panel entitled “Current Issues in the Law of Surrogacy: A Cross Canada Check-Up.” Panelists will address a range of issues, including:

  • Does the surrogate’s name need to be on the birth certificate?
  • Does the partner’s name need to be on the birth certificate?
  • How quickly can parents obtain a birth certificate which includes the names of both intended parents on it?
  • How quickly can they be on a plane after the birth?
  • Are there any unique issues/rules in your jurisdiction?
  • How do you advise your client on the law and their legal obligations?
  • Tips, tools and best practices for lawyers.

Also, MP Anthony Housefather, chairman of the House of Commons Standing Committee on Justice and Human Rights, will speak about the need to change the criminal prohibitions in the Assisted Human Reproduction Act relating to compensated surrogacy and gamete donation.
