Lonny Rosen to speak at inaugural Elderly Client course

Toronto health lawyer Lonny Rosen will be speaking at the inaugural Elderly Client two-day course for legal and financial professionals to gain insight into one of the fastest-growing segments of the Canadian population.

Drawing on his experience advising health care practitioners as well as individuals, and as a member of the Consent and Capacity Board, Rosen, partner at Rosen Sunshine LLP, will discuss how to determine capacity and dealing with challenges during the event scheduled for Jan. 21 and 22 and hosted by Federated Press, an independent research-based organization.

"The concept of capacity is one of the most vital issues when dealing with elderly clients, however it is an area of the law that remains a source of ongoing confusion and complexity," says the course description for Rosen's session. "This session will review the definitions and tests for capacity to consent to treatment and admission to a care facility as well as capacity to manage property. It will also explore best practices for assessing capacity."

Rosen will look at case law with respect to tests for capacity assessments, raising the concern about lack of capacity, responding to challenges to client capacity, and seeking an outside opinion. Rosen will also look at the definition of, and test for, capacity in the Health Care Consent Act and Substitute Decisions Act.

The course will look at, among other things, strategies for using trusts to protect accumulated wealth in a tax efficient basis; concepts of financial abuse of the elderly and the latest developments in financial abuse litigation; efficient financial, legal and taxation issues and how to make sure you cover all your bases to avoid excess taxation; the definitions and tests for capacity to consent to treatment and admission to a care facility as well as capacity to manage property.
