Toronto criminal lawyer Roots Gadhia tells SunTV's Daily Brief show that a not guilty plea and request by the lawyer for Lukas Magnotta to have a psychiatric evaluation is likely setting the stage for a defence of not criminally responsible.

"Any lawyer worth his salt will probably look at these offences as being so completely above what we would consider normal behaviour," says Gadhia.

She notes that the issue will be whether was he, at the time the offences were committed, "experiencing a psychotic episode, was there a mental disorder, was there something that made him snap to do this. If the psychiatric evaluation proves that to be the case, then yes, it's an NCR judmenet in which case rather than spending the rest of his life in prison he would be sent to a hospital and kept under evaluation until such time they found him either to not be a danger to the pubic, or indefinitely."
